The Council applied to the Upper Tribunal Lands Chamber seeking relief from the Restrictive Covenants relating to the car park on 27 June 2017. The Council’s ‘Statement of case’ is attached.
The matter is still subject to determination by the Lands Tribunal. In October last year, it instructed the Council to consult with residents living within a radius of 200 metres from the site and the Association understands that there has been strong resistance from consultees against the change of use with formal objections from around 25% of residents consulted (48 of approx. 200).
